The chosen theme is advertising and marketing law, two highly competitive domains in which the creativity of advertisers often falls foul of the requirements laid down by law.
The creation of advertising requires the participation of many actors. To anticipate potential disputes, allowance must be made for every eventuality and suitable contracts drafted. A lecture on this subject will be given by Me Guillaume Fournier, an attorney who is a partner of Meyer Lustenberger in Zurich; he will describe the pitfalls which right holders must avoid to secure the best possible protection for advertising creations.
A second lecture will deal with unfair competition in the world of watchmaking. On this occasion, Me Magda Streuli- Youssef, attorney with Walder Wyss & Partners in Zurich, will be examining the legal bases, the limits and the rules of conduct to be observed to avoid any dispute over comparative or misleading advertising.
As a prelude to these two lectures and in his capacity as professor at Geneva University, Jacques de Werra will open the seminar by presenting the latest developments of case law in the area of trademarks, designs and patents and in the field of unfair competition.
